Privacy Policy

This Policy explains what personal data Smekal Solutions ("we", "us") collects through our applications and services, why, and your rights. We have designed our software to collect as little as possible.
This Policy covers all software published by Smekal Solutions and the application packaging, migration, and testing services we provide. Most of our applications are free tools that run entirely on your own computer and do not collect, transmit, or store any personal data. The only application that collects personal data is SwiftPack Studio, which requires an account and a license to operate; the account-related sections below apply only to SwiftPack Studio. Sections relating to our services apply when you engage us for application packaging or related services.
1. Applications That Do Not Collect Data
Except for SwiftPack Studio, our applications:
- do not require an account, registration, or login;
- do not collect, transmit to our servers, or store any personal data;
- do not include analytics, telemetry, crash reporting, or usage tracking;
- operate entirely on your own computer.
For these applications, there is no personal data for us to process, share, or retain.
2. Data We Collect (SwiftPack Studio only)
Account data you provide at registration:
- user name;
- e-mail address;
- password - stored only as a salted cryptographic hash; we never store or can recover your plaintext password.
Licensing data generated during use:
- a randomly generated session identifier, created by our server at each login and used to enforce the one-active-machine license. It is not derived from your hardware and contains no information about your computer;
- trial and license status and dates, and login/heartbeat timestamps;
- verification and password-reset codes (temporary).
3. Data We Do NOT Collect
Across all our applications, including SwiftPack Studio, we do not collect, transmit to our servers, or have access to:
- the applications, installers, scripts, files, or configurations you work with in the software;
- your Microsoft Intune credentials, tenant data, or anything published to Intune (SwiftPack Studio);
- any hardware identifiers, serial numbers, or machine names - where the software derives a value from your Windows installation, it does so solely to encrypt its local license cache on your own disk, and that value never leaves your computer;
- any usage analytics or telemetry of how you use the software’s features.
All work you perform in our applications happens on your own machine and, where applicable, within your own Microsoft tenant.
4. Why We Process This Data (SwiftPack Studio only)
- to create and manage your account and authenticate logins;
- to administer the free trial and any commercial license;
- to enforce the one-active-machine license;
- to send verification and password-reset e-mails;
- to secure the service and provide support.
The legal bases (where the GDPR applies) are performance of our contract with you (the EULA) and our legitimate interest in securing and licensing the Software.
5. Where Data Is Stored (SwiftPack Studio only)
Account and licensing data are stored on our license server hosted by a third-party cloud infrastructure provider, with data held within the European Union. Verification and notification e-mails are sent through a third-party e-mail delivery provider. These providers act as our processors and do not use your data for their own purposes. If you access the Software from outside the European Union, your data will be transferred to and stored in the European Union; where required, we put appropriate safeguards in place to protect it.
6. Application Packaging and Related Services
When you contact us for, or engage us to provide, application packaging, migration, or testing services, we process:
- business contact details you provide, such as your name, work e-mail, company, and the contents of your enquiry or quote request;
- materials you supply for the engagement, such as application installers, scripts, packaging configurations, requirements, and related documentation.
We use business contact details to respond to enquiries, prepare quotes, deliver the service, and manage our business relationship with you. The legal bases (where the GDPR applies) are taking steps at your request before entering a contract, performance of our contract with you, and our legitimate interest in operating and marketing our services.
Materials you supply are used solely to perform the agreed service. We do not use them for any other purpose and do not share them except with subcontractors or providers engaged to deliver the service, under confidentiality obligations, or where required by law. Where these materials contain personal data, we act as a processor on your behalf and process them in accordance with your instructions and our service agreement; you remain responsible for ensuring you have the right to share them with us. We return or delete engagement materials when they are no longer needed for the service, except where retention is legally required.
7. Sharing
We do not sell your personal data and do not share it with third parties except the hosting and e-mail processors described above, the service providers and subcontractors described in Section 6, or where required by law.
8. Retention
For SwiftPack Studio, we retain account and licensing data for as long as your account exists and as needed for the purposes above. Server logs are retained for a limited period for security and then deleted. On account deletion we remove your personal data except where retention is legally required. For services, we retain business contact details for as long as needed for our business relationship and applicable record-keeping, and we return or delete engagement materials as described in Section 6.
9. Your Rights
Depending on your jurisdiction - including under India’s Digital Personal Data Protection Act, 2023, the EU and UK General Data Protection Regulation (GDPR), and the Australian Privacy Act 1988 - you may have the right to access, correct, update, or delete your personal data, to withdraw consent, and to lodge a complaint with your local supervisory authority. As our free applications do not collect personal data, these rights are most relevant to SwiftPack Studio and our services. Where we process material as a processor on a client’s behalf, requests relating to that data should be directed to the client who controls it. 10. Security
Where we hold data, passwords are salted and hashed; license tokens are cryptographically signed; and traffic between the software and our server is encrypted in transit (HTTPS). No method of transmission or storage is completely secure, but we take reasonable measures to protect your data.
11. Children
Our software and services are professional offerings not directed to children and not intended for anyone under the age of 18.
12. Changes
We may update this Policy. We will revise the “Effective date” and, for material changes, provide notice. Continued use after an update constitutes acceptance.
